Refund Policy

At Canada Dev Academy, we are committed to delivering high-quality software development services that meet your business needs. We understand that circumstances may arise that require you to seek a refund. This Refund Policy outlines the conditions under which refunds may be granted and the process for requesting them.

1. Scope of This Policy

This Refund Policy applies to all software development services provided by Canada Dev Academy, including but not limited to:

  • Custom software development projects
  • Dealer Management System (DMS) implementations
  • Fleet management platform development
  • Digital retailing solutions
  • Mobile application development
  • API integration services
  • Consulting and advisory services
  • Support and maintenance packages

2. Refund Eligibility

Refund eligibility depends on the type of service, the stage of the project, and the specific circumstances of your request.

2.1 Project Cancellation Before Commencement

If you cancel a project before any work has begun (prior to the project kickoff meeting), you are entitled to a full refund of any deposits paid, less a 5% administrative fee to cover contract preparation and resource allocation costs.

2.2 Project Cancellation During Development

If you cancel a project after work has commenced:

  • You will be charged for all work completed up to the cancellation date based on documented hours and deliverables
  • Any payments made in excess of work completed will be refunded within 30 business days
  • You retain ownership of all deliverables completed and paid for at the time of cancellation
  • A 15% early termination fee may apply if the cancellation occurs after significant resources have been allocated to your project

2.3 Milestone-Based Projects

For projects using our standard milestone payment structure:

  • Milestone payments are non-refundable once the corresponding milestone has been approved
  • If you are dissatisfied with a milestone deliverable, you must raise concerns within 14 days of delivery
  • We will work to address legitimate concerns before the milestone is considered complete
  • Refunds for incomplete or unsatisfactory milestones will be evaluated on a case-by-case basis

2.4 Monthly Retainer Services

For ongoing support and maintenance retainers:

  • Retainer fees are billed monthly in advance and are non-refundable once the service period has begun
  • You may cancel future retainer periods with 30 days written notice
  • Unused hours from the current billing period do not roll over or qualify for refunds
  • Annual retainers paid upfront may be refunded on a pro-rata basis for remaining months, less a 10% early cancellation fee

3. Non-Refundable Services

The following services and fees are generally non-refundable:

  • Third-party software licenses, subscriptions, or services purchased on your behalf
  • Domain registrations and SSL certificates
  • Cloud hosting and infrastructure costs
  • Completed and approved deliverables
  • Consultation and discovery sessions that have been conducted
  • Emergency or rush service fees
  • Training sessions that have been delivered

4. Satisfaction Guarantee

We stand behind the quality of our work. If you are not satisfied with a deliverable:

  • Notify us in writing within 14 days of receiving the deliverable
  • Clearly describe the issues or deficiencies you have identified
  • We will work with you to address legitimate concerns at no additional cost
  • If we cannot resolve the issues to your reasonable satisfaction after two revision cycles, we will discuss partial refund options

Our satisfaction guarantee does not apply to:

  • Changes in project requirements after approval
  • Subjective design preferences not specified in the original scope
  • Issues caused by third-party systems, data, or integrations beyond our control
  • Problems resulting from client-provided specifications or materials

5. How to Request a Refund

To request a refund, please follow these steps:

  • Step 2: Provide your project reference number, invoice numbers, and a detailed explanation of your refund request
  • Step 3: Our team will acknowledge your request within 2 business days
  • Step 4: We will review your request and respond with a determination within 10 business days
  • Step 5: Approved refunds will be processed within 30 business days of approval

6. Refund Processing

Approved refunds will be processed using the original payment method when possible:

  • Credit/Debit Cards: Refunds will be credited to the original card within 5-10 business days of processing
  • Wire Transfers: Refunds will be sent via wire transfer within 10-15 business days
  • Checks: Refund checks will be mailed within 15 business days

Please note that your bank or financial institution may take additional time to post the refund to your account.

7. Disputes

If you disagree with our refund determination:

  • You may request escalation to our management team within 14 days of receiving our initial determination
  • Provide any additional documentation or information supporting your position
  • Our management team will conduct a final review and provide a decision within 14 business days
  • For unresolved disputes, parties agree to pursue mediation before any legal action, as outlined in our Terms and Conditions

8. Exceptions

Canada Dev Academy reserves the right to make exceptions to this policy on a case-by-case basis. Exceptions may be granted at our sole discretion based on:

  • Long-standing client relationships
  • Extraordinary circumstances beyond either party's control
  • Documented service failures on our part
  • Other factors we deem relevant

9. Changes to This Policy

We may update this Refund Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated policy. The policy in effect at the time of your purchase or service agreement will apply to that transaction.
